General FAQ's

What documents have to be filed with the bankruptcy court?

A Chapter 7 or Chapter 13 bankruptcy filing consists of a petition which requests the bankruptcy court for relief from creditors. Included with the petition are forms ("schedules") that list all real and personal property and all creditors. Also, the court requires a statement of monthly income, a statement of the basic household budget and a statement of financial affairs. The Chapter 7 and Chapter 13 schedules are basically the same; however, a Chapter 13 also includes the Chapter 13 plan in which the consumer tells the court how he or she intends to pay the listed debts and states the duration of the plan. The experienced bankruptcy attorneys at the Hanson Law Office will draft the plan and attend to the many details that must be addressed in a Chapter 13 filing.

How much does it cost to file a bankruptcy?

The Bankruptcy Court requires a filing fee of $200 for a Chapter 7 bankruptcy and $185 for a Chapter 13. Our legal fees are usually quoted as a flat fee, based on the facts of your individual case and the anticipated complexities presented by your situation. Payment arrangements can be made, but we usually require at least half of our stated fee and the filing fee before filing. You will find that our legal fees are competitive with other law firms doing bankruptcy law in the Milwaukee area. An initial consultation with an experienced bankruptcy attorney is free, during which we will advise you on a possible course of action and quote you a reasonable fee for our services.
